I’m going to DFAU competition

1. ABOUT THE COMPETITION

1.1  This competition (Competition) is promoted by DrachenFest AU ABN 78681479943 (Promoter).

1.2  By entering the Competition, entrants agree to be bound by these Terms and Conditions (Terms). These Terms form a binding agreement between the entrant and the Promoter.

1.3  The Competition is a game of skill. Chance plays no part in determining the winner. The most creative and compelling video submission, as judged against the criteria in clause 8, will win.

1.4  The Competition is open to residents of Australia only, subject to the eligibility requirements in clause 3.

1.5  Entry is free. No purchase is necessary to enter.

 

2. COMPETITION PERIOD

2.1  The Competition opens at 5:00pm Australian Eastern Standard Time (AEST) on 7 August 2026 (Opening Date) and closes at 10:00pm AEST on 31 August 2026 (Closing Date) (Competition Period).

2.2  Entries received outside the Competition Period will not be accepted. The Promoter accepts no responsibility for late, lost, delayed, incomplete, or misdirected entries.

2.3  The Promoter reserves the right to extend, shorten, or modify the Competition Period, subject to any applicable regulatory requirements and prior notification to entrants via [website/social media channel].

 

3. ELIGIBILITY

3.1  To be eligible to enter and win the Competition, an entrant must:

  • be a natural person and a permanent resident of Australia at the time of entry;

  • be aged 18 years or older at the time of entry (or [minimum age] years or older, subject to applicable State/Territory laws);

  • comply with all entry requirements set out in clause 4; and

  • not be an employee, contractor, director, officer, or agent of the Promoter or any related body corporate, or an immediate family member of any such person.

3.2  Where a State or Territory requires a minimum age greater than 18 years for participation in promotional competitions, the higher age limit applies to residents of that jurisdiction.

3.3  Entries submitted by persons who are not eligible will be disqualified.

 

4. HOW TO ENTER

4.1  To enter the Competition during the Competition Period, entrants must:

  1. Complete the competition entry form on the competition landing page that can be found on the DrachenFest AU website https://www.drachenfest.com.au/video-contest;

  2. record and upload an original video submission that meets the Video Requirements in clause 5;

  3. grant the consents required under clause 9 of these Terms by confirming consents on the entry form; and

  4. accept and agree to these Terms in full by confirming agreement on the entry form.

4.2  Limit of entries: Each person may submit a maximum of one entry during the Competition Period. Multiple entries beyond this limit will be disqualified.

4.3  The Promoter is not responsible for any technical failures, network outages, or other issues that prevent a valid entry from being received. Proof of submission is not proof of receipt.

 

5. VIDEO SUBMISSION REQUIREMENTS

5.1  All video submissions must:

  • be an creation of the entrant;

  • be filmed and submitted either in or subtilted with English;

  • be no longer than 10 seconds in duration;

  • be submitted in MP4 / MOV / AVI format and must not exceed 500MB in size;

  • clearly feature the entrant;

  • not feature any person other than the entrant unless that person has given their prior written consent, a copy of which must be able provide following their entry should this be requested;

  • not contain any third-party intellectual property (including music, logos, trademarks, or copyrighted material) without the prior written consent of the rights holder;

  • respond to the following brief: show themselves in their character costume they intend to wear for DrachenFest AU 2026 event; and

  • comply with the Content Standards in clause 6.

5.2  Submissions that fail to meet the requirements set out in clause 5.1 may be disqualified at the sole discretion of the Promoter.

5.3  The Promoter reserves the right to request the original unedited footage from a winner to verify authenticity and eligibility prior to awarding any prize.

 

6. CONTENT STANDARDS

6.1  All video submissions must not contain content that:

  • is unlawful, defamatory, harassing, threatening, discriminatory, or offensive under Australian law;

  • vilifies any person on the basis of race, sex, age, disability, sexual orientation, religion, or other attribute protected under the Racial Discrimination Act 1975 (Cth), Sex Discrimination Act 1984 (Cth), Age Discrimination Act 2004 (Cth), or applicable State and Territory anti-discrimination legislation;

  • infringes the intellectual property rights, privacy rights, or other rights of any third party;

  • features, identifies, or may be likely to identify any person under the age of 18 years;

  • contains nudity, sexually explicit content, gratuitous violence, or content that would otherwise be objectionable to a reasonable person; or

  • promotes a third-party business, product, or service in a manner that could reasonably be characterised as commercial advertising.

6.2  The Promoter may disqualify any entry that, in its reasonable opinion, does not comply with these Content Standards or is otherwise inappropriate.

 

7. THE PRIZE

7.1  There are two (2) prizes available in this Competition (Prizes), being:

  • First prize - DFAU Merch Pack with camp of choice valued at AUD $167, containing:
    1 DFAU T-shirt, 1 Camp T-shirt, 1 Tote bag, 1 DFAU pin, 1 Camp pin, 1 Camp mug, 1 Camp coaster, 1 DFAU coaster, 1 DFAU Stein, 1 Camp bookmark, 1 Large dragon sticker, 1 Small dragon sticker, 1 Small sleeping dragon sticker, 1 Camp symbol sticker, 1 DFAU sticker

  • Second prize - Camp Merch Pack with camp of choice valued at AUD $85, containing:
    1 Camp T-shirt, 1 Camp pin, 1 Camp mug, 1 Camp coaster, 1 Camp bookmark, 1 Large dragon sticker, 1 Small dragon sticker, 1 Small sleeping dragon sticker, 1 Camp symbol sticker

7.2  The Prize is not transferable, exchangeable, or redeemable for cash, unless required by law.

7.3  If for any reason the Prize (or a component of it) is unavailable, the Promoter reserves the right, subject to any applicable State and Territory laws, to substitute the Prize with a prize of equal or greater value.

7.4  Tax implications: The Prize winner is solely responsible for any and all tax obligations that may arise from acceptance of the Prize, including any fringe benefits tax or income tax. The Promoter recommends that winners seek independent financial and tax advice.

7.5  The Prize must be accepted as offered. The Promoter is not responsible for any costs associated with acceptance of the Prize that are not expressly included in the Prize description.

 

8. JUDGING

8.1  This Competition is a game of skill. The winner will be determined by a panel of judges appointed by the Promoter (Judging Panel).

8.2  The Judging Panel will assess all eligible entries against the following criteria and respective weightings:

Judging Criterion - Weighting

Creativity and Originality - 15%

Relevance to Competition Brief - 30%

Production Quality - 15%

Audience Appeal - 40%

 

8.3  The decision of the Judging Panel is final and no correspondence will be entered into.

8.4  Judging selection will take place on 7 September 2026 at 7:00PM AEST. The winner will be notified by email on or before 8 September 2026.

8.5  If the winner cannot be contacted within 10 business days after the initial notification, the Promoter reserves the right to award the Prize to a subsequent entrant determined by the Judging Panel (“second-chance draws” will be conducted and announced in this event).

 

9. CONSENT TO USE VIDEO SUBMISSIONS

IMPORTANT — Please read this clause carefully before entering.

 

9.1  Grant of Licence

By submitting an entry, each entrant grants the Promoter a non-exclusive, royalty-free, perpetual, worldwide, sublicensable, and transferable licence to use, reproduce, modify, adapt, publish, distribute, display, broadcast, and otherwise exploit the entrant's video submission (Submission) and the entrant's name, likeness, image, and voice as captured in the Submission, in any and all media now known or hereafter developed, for the purposes set out in clause 9.2 (Licence).

9.2  Permitted Purposes

The Promoter may use the Submission for the following purposes:

  • publication on the Promoter's website and social media channels, including but not limited to platforms such as Instagram, Facebook, YouTube, TikTok, etc.;

·        use in marketing, promotional, and advertising materials in any medium;

  • internal business purposes, including presentations and reports;

  • press and media coverage relating to the Competition.

9.3  Moral Rights Consent

To the extent permitted by the Copyright Act 1968 (Cth), each entrant:

  • consents to the Promoter exercising the Licence in a manner that does not attribute the Submission to the entrant or that attributes the Submission in a manner determined by the Promoter; and

  • consents to the Promoter making adaptations, modifications, or other alterations to the Submission as reasonably required for the Permitted Purposes.

9.4  Entrant's Warranties

By entering, each entrant represents and warrants to the Promoter that:

  1. the Submission is the entrant's original work;

  2. the entrant is the sole owner of all intellectual property rights in the Submission, or has obtained all necessary licences, consents, and permissions from third-party rights holders to grant the Licence to the Promoter;

  3. the Submission does not infringe the intellectual property rights, privacy rights, moral rights, or any other rights of any third party;

  4. the entrant has obtained the prior written consent of every identifiable individual (other than the entrant) who appears in the Submission, and such consents are valid and subsisting; and

  5. the Promoter's exercise of the Licence will not expose the Promoter to any claim, liability, loss, or demand by any third party.

9.5  Indemnity

Each entrant indemnifies and will keep indemnified the Promoter, its related bodies corporate, and their respective officers, employees, and agents (Indemnified Parties) against all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with any breach of the warranties in clause 9.4 or any claim by a third party relating to the Submission.

9.6  Right to Withdraw Consent

An entrant may withdraw their consent to future publication or use of their Submission by providing written notice to the Promoter at CommunitySafety@drachenfest.com.au. Such withdrawal will not affect:

  • any prior use of the Submission that occurred before receipt of the withdrawal notice;

  • the entrant's eligibility to participate in or win the Competition; or

  • uses of the Submission that the Promoter is contractually committed to at the time of receiving the notice.

 

10. INTELLECTUAL PROPERTY

10.1  Subject to the Licence granted in clause 9.1, the entrant retains all intellectual property rights in their Submission.

10.2  All intellectual property rights in the Competition itself (including the Competition name, branding, website, and promotional materials) vest in and remain the property of the Promoter.

10.3  No intellectual property rights in the Promoter's brand or materials are transferred to entrants by reason of participation in the Competition.

 

11. PRIVACY AND PERSONAL INFORMATION

11.1  The Promoter collects personal information (including name, contact details, and image/likeness in video submissions) for the purpose of administering the Competition, notifying and awarding the Prize, and as set out in clause 9.

11.2  The Promoter handles all personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). The Promoter's Privacy Policy is available at https://www.drachenfest.com.au/privacy-policy.

11.3  By entering, entrants consent to the Promoter:

  • collecting, storing, using, and disclosing personal information for the purposes described in these Terms and the Promoter's Privacy Policy;

  • disclosing personal information to third parties who assist the Promoter in administering the Competition (e.g., technology service providers, prize fulfilment partners), subject to appropriate confidentiality obligations; and

  • where indicated at the time of entry, using personal information to send marketing communications about the Promoter's products, services, and future promotions.

11.4  Entrants may request access to, correction of, or deletion of their personal information by contacting the relevant officer at CommunitySafety@drachenfest.com.au.

 

12. REGULATORY COMPLIANCE

12.1  This Competition is conducted in accordance with applicable Australian State and Territory lottery and gaming legislation, including (where applicable):

  • Lotteries Act 1964 (ACT);

  • Lotteries and Art Unions Act 1901 (NSW);

  • Gaming Control Act 1993 (NT);

  • Lotteries Act 1997 (QLD);

  • Lottery and Gaming Act 1936 (SA);

  • Gaming Control Act 1993 (TAS);

  • Gambling Regulation Act 2003 (VIC); and

  • Gaming and Wagering Commission Act 1987 (WA).

12.2  This Competition is also conducted in compliance with the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), including the prohibition on misleading and deceptive conduct (s. 18 ACL) and the unfair practices provisions.

 

13. CONSUMER LAW GUARANTEES

13.1  To the extent permitted by law, the Promoter limits its liability to entrants. Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the ACL that cannot lawfully be excluded or limited.

13.2  Where legislation implies any guarantee into these Terms that cannot be excluded, the Promoter's liability for breach of such a guarantee is limited, to the maximum extent permitted by law, to:

  • in the case of goods: replacing the goods, supplying equivalent goods, repairing the goods, paying the cost of replacing or repairing the goods, or paying the cost of having equivalent goods supplied; and

  • in the case of services: supplying the services again or paying the cost of having them supplied again.

13.3  The Promoter is not liable for any loss or damage (including indirect or consequential loss) suffered by any entrant in connection with the Competition, except to the extent such liability cannot be excluded under the ACL or other applicable law.

 

14. DISQUALIFICATION AND CANCELLATION

14.1  The Promoter may disqualify any entrant who:

  • does not comply with these Terms;

  • provides false or misleading information in connection with their entry;

  • tampers with or seeks to gain an unfair advantage in the Competition; or

  • engages in conduct that is harmful, disruptive, or contrary to the spirit of the Competition.

14.2  The Promoter reserves the right to cancel, suspend, or modify the Competition in the event of any circumstances beyond the Promoter's reasonable control (including force majeure events, technical failures, or regulatory requirements), subject to any required regulatory approvals.

14.3  If the Competition is cancelled or modified, the Promoter will notify entrants via [website/social media channel] and will endeavour to minimise any adverse impact on entrants.

 

15. LIMITATION OF LIABILITY

15.1  To the extent permitted by law and subject to clause 13, the Promoter and its related bodies corporate, officers, employees, agents, and contractors are not liable for:

  • any loss, damage, or injury arising from participation in the Competition or acceptance of the Prize;

  • technical failures or other problems with any computer, network, server, provider, or other equipment or software;

  • lost, misdirected, or incomplete entries; or

  • any third party's unauthorised use of the entrant's Submission.

 

16. GOVERNING LAW

16.1  These Terms are governed by and construed in accordance with the laws of Victoria, Australia.

16.2  Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Victoria and the Federal courts of Australia.

17.2  Complaints regarding this Competition should be directed to the contact above in the first instance. If a complaint is not resolved to the entrant's satisfaction, the entrant may refer the matter to the relevant State or Territory gaming/lottery regulator or the Australian Competition and Consumer Commission (ACCC).

 

18. GENERAL

18.1  If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be severed from the Terms, and the remaining provisions will continue in full force and effect.

18.2  These Terms constitute the entire agreement between the Promoter and the entrant with respect to the Competition and supersede all prior representations, negotiations, or arrangements.

18.3  The Promoter's failure to enforce any right under these Terms does not constitute a waiver of that right.

18.4  The Promoter may amend these Terms at any time, provided that material amendments affecting entrant rights will be notified via DrachenFest Australia website with at least 2 days' notice.
